Please read these Terms & Conditions as they affect your rights and responsibilities in law. If they are not acceptable to you please do not order from us. By accepting these Terms and Conditions, including the Privacy Policy, you are giving express consent to the use of your data as described below. This policy is regularly reviewed. last updated May 18.

These Terms & Conditions do not affect your Statutory Rights.

Important Disclaimer: The information is provided on the understanding that the website is not engaged in rendering advice and should not be wholly relied upon when making any related decision. Always consult a qualified doctor or health practitioner, especially if you are pregnant, have a known medical condition or are on any medication. Your situation will need to be looked at individually and you should not attempt to self-treat. Purehealth Clinic cannot accept responsibility for any illness arising out of failure to seek medical advice from a doctor.

The information contained with the Website is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website. 

We do not guarantee uninterrupted availability of the Website and cannot provide any representation that using the Website will be error free.

 

1 Interpretation

1.1 Definitions

Buyer/You the person or business who purchase the goods from the companyCompany/We Purehealth Clinic, Chy An Mor, Plaidy Park Road, Looe, Cornwall PL13 1LG which is our registered office and trading addressGoods – any goods supplied to the Buyer by the CompanySite www.purehealthshop.ecwid.com

1.2 Singular words include the plural and vice versa.

1.3 Reference to gender covers both genders.

1.4 The Site is intended for use by persons or business resident in the United Kingdom.

1.5 The Site is available free of charge for personal and business use.

Purchasing, Delivery & Returns

2.1 Orders placed and purchases made are governed as follows:

2.1.1 All prices shown are retail selling prices inclusive of value added tax and shipping unless otherwise stated. Some prices come up as £0.00 and those you pay the labs direct when requested later on. Please see the FAQ for more on this.

2.1.2 All prices are subject to change without notice being given.

2.1.3 Should we not be able to supply an item for a reason beyond our control we will not accept liability.

2.1.4 Placing an order does not necessarily mean we will fulfil it. Only when we invoice and dispatch the Goods is the Contract between the Buyer and Company acknowledged and confirmed.

2.1.5 Delivery will be made to the address given when placing your order.

2.1.6 Depending on the size and type of order, it will be dispatched either by first or second class Royal Mail or you will be alerted by email when a download is available. Please remember to save your download straightaway before your links expire!

2.1.7 Under normal circumstances orders will be dispatched within 4 days of the order being received, usually much quicker, unless there are holidays or illness when we will endeavour to place a notice on the site so you are aware.

2.1.8 Postal charges to UK destinations excluding Channel Islands and Isle of Man are as follows:Downloads are free, of course, straight to your inbox. Other orders are generally sent second class by Royal Mail FREE or charged by weight if heavy. Orders for overseas destinations will be charged at cost.

2.1.9 If Royal Mail or our couriers fail to deliver your Goods in part or in full or it is beyond our control we will not be held liable. However, we will use our best endeavours to ensure you are recompensed for the loss.

2.1.10 If you wish to return anything you may do so within 14 days for a full refund, providing that the product has not been opened or otherwise used. Digital products nowadays are usually sold on the basis that once downloaded, they are non-returnable. However, if you genuinely have an issue (thankfully this is very rare!), then do email me and we will sort it out. Note that some labs may charge a restocking, cancellation or postage fee for return of tests. Not often, but it does happen. Similarly, if I have spent a deal of time on sorting something for you, I reserve the right to charge a cancellation fee too, or to charge for the use of a digital product if I think you will have gained benefit from it. Please obtain a proof of postage for all returns. Any problems, email enquiries@purehealthclinic.co.uk and we will help sort it.

2.1.11 Any items damaged must be notified within 48 hours of receipt (see 2.1.10 for telephone or email). 

2.1.12 In accordance with the distance selling Regulations 2000, customers have the right to cancel their order within seven days. An order may be subject to cancellation or changed by sending an e-mail or by telephone (see 2.1.10) unless a download has been accessed.

2.1.13 Payment may be made by BACs, cheque or Paypal. All in pounds sterling. Our liability to you relating to any order will not exceed the total value for the particular goods. All data processing is done through secure processors such as the bank and Paypal. I do not collect or hold any credit or debit card information. If you pay by cheque, that cheque is sent direct to the bank by secure post.

 

3 The Law

These Terms & Conditions as numbered 1 to 16 shall be governed by and construed in accordance with the laws of England and Wales and the English Courts will rule over any disputes. If any of the Terms are held by any Court or competent authority to be unlawful, invalid or unenforceable in whole or part, this will not reflect in the validity of the other terms which will still be valid and enforceable to the extend allowed by law.

Amendments We reserve the right to amend these Terms & Conditions and will publish these on our site as they occur and apply from the day of publication.

 

Registration

5.1 When registering do be sure that your details are accurate and complete. Include all details asked for so we have the correct info for the lab. Failure to do so may affect your test order and/or results and we will not be held liable. We only ask you to register so we have all the details for the lab and so we don’t have to spend time emailing you for them, ta.

The info gathered includes your name, address, date of birth in some cases, which is needed for some labs, order comments and order details. By giving your details, you are expressing explicit consent for Purehealth to have that data, which is used only to process and fulfil your order. The data is then held on Ecwid, the data controller, and Purehealth has access to it via a password-protected website. Neither Ecwid, nor Purehealth holds any payment card details; those are processed through secure Paypal and bank processors. At any time, you can ask for a copy of the data held, or for it to be deleted, amended or consent for it to be held revoked at any time. If there is ever a security breach where Ecwid or Purehealth think your data may have been accessed by someone who shouldn’t have, either of us will let you know within 72 hours of becoming aware of it. See more on Privacy (14) below.

5.2 Remember to let us know immediately if any of your details change.

 

Security 

6.1 When first registering on the Site you will need to create and enter your password, which must remain strictly confidential. Do not tell anyone what it is.

6.2 Your password is your responsibility. All orders submitted under this password will be your responsibility.

6.3 If Purehealth Clinic suspect that our site is being misused, we may be obliged to suspend your account.

 

Promotions 

7.1 Promotions are available from time to time and these have time limits and/or while stocks last. Should the promotion have finished prior to receiving your promotional order we will notify you before sending the Goods.

7.2 Refunds are not normally given against promotional offers. Much depends on the terms of the offer. However your statutory rights are not affected.

Intellectual Property

8.1 The content of our site is protected by copyright trade marks, database and other intellectual property. You may retrieve and display the content of the Site on a computer screen or save on a memory stick. You pay print one copy for your own use. However you may not store on a server or any other storage device connected to a network. By using the Website you agree to respect the intellectual property rights of Purehealth Clinic and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website.

 

8.2 You may not use any trade mark of Purehealth Clinic.

 

Site Availability 

9.1 Purehealth Clinic endeavours to offer the best possible service. Nonetheless it cannot guarantee that the service will always be without fault or meet all your needs. Should a fault occur we would be grateful if you report it to customer services by email (enquiries@purehealthclinic.co.uk).

9.2 Site access may not always be available as a result of maintenance or the addition of new products.

 

10 Right To Cancel Registration

You may cancel your registration at any time. You must stop using the site if you do. Cancellation shall not affect your rights or liabilities.

11 Purehealth Clinic’s Right to Cancel Your RegistrationPurehealth Clinic may cancel your registration at any time should you breach any of your obligations under these Terms & Conditions.

 

12 Purehealth Clinic’s Liability 

12.1 Purehealth Clinic provides the Site without any warranties or guarantees. The risks associated with use of the Internet shall be borne by you.

12.2 Material from other Internet sites is provided by our Site. We try to ensure this material is of good quality, reputable and within the law we cannot be held responsible if this proves not to be the case.

12.3 Neither can we be held responsible for any technical problems experienced with the Site and we disclaim all liabilities where your equipment links are incompatible or interruptions or errors due to technical problems occur.

12.4 You also accept that we cannot be held responsible to you or any third party for any incidental damage or considerable loss of revenue that are concerned with the Site insofar as applicable law allows.

 

13 Overseas Use 

Purehealth Clinic cannot know that information and materials on its site are appropriate or available for use anywhere outside the United Kingdom. If you reside outside the UK and you decide to order any product from this Site you do so on the understanding that is it on your own initiative and it is your responsibility to comply with local law.

 

14 Privacy/Data Protection

Any personal data submitted by you on this Site is for the use of Purehealth Clinic only. Our aim is to keep your data secure, use only what we need to and for the relevant purpose for which it was given. This policy is regularly reviewed. Last updated May 18.

Within the health sector, we also have to follow the common law duty of confidence, which means that where identifiable information about you has been given in confidence, it should be treated as confidential and only shared for the purpose of providing direct healthcare. We will protect your information, inform you of how your information will be used, and allow you to decide if and how your information can be shared.

We also ensure the information we hold is kept in secure locations, restrict access to information to authorised personnel only, protect personal and confidential information held on equipment and in cloud storage with strong passwords as a minimum and do not store hard copies of data anywhere.

Personal data use

Your personal data includes your name, address, date of birth where required for specific labs, order comments, order details, phone number and email address and IP address.

By giving your details on the shop or by email as a query, say, you are expressing legitimate consent for Purehealth to have that data, which is used to process and fulfil your order or request for help. The shop data is then held on Ecwid, the data controller, and Purehealth has access to it via a password-protected website. Neither Ecwid, nor Purehealth holds any payment card details; those are processed through secure Paypal and bank processors.

You data may be used by Paypal, who process your payments, Ecwid, who sends you your downloads and holds your data on secure servers, passed to secure labs who send your test kits out, or by Purehealth staff or allied secure therapists, to help us with your specific case or query. By giving us your data and accepting these terms, you are giving us explicit permission to do all this.

Purehealth may also store your data for the purpose of sending a regular newsletter, if you have given your explicit consent for that. This might be via Mailchimp or ConvertKit, or some other email management provider as necessary. These are secure data processors and Purehealth has access to the data only via a strong password-protected site. You can, of course, unsubscribe at any time using the unsubscribe link at the bottom of every newsletter email.

You give us your data mostly by purchasing something on the Ecwid shop, although you may also give it via emails, phone or social media conversations.

Any personal comments that you give in support of your order in the comments box on Checkout on Ecwid or via email, social media, via the phone or post are kept strictly confidential. In giving that info, you are enabling us to ensure the best service to you and is thus used under legitimate interest. We may use it to contact you to ask any questions we have either about your order or your case. It may also be seen by (very rarely) by any other Purehealth staff or allied therapists if I think they are the best person to help you. We will only pass information to secure data controllers.

Your lab test results are either accessed from a password-protected lab site or sent to my secure email address (G-Suite: Gmail for Business). Your results are forwarded to you with my comments via a safe portal such as StayPrivate as appropriate and then deleted or kept as an attachment within your emails thread for up to a year.

How long we hold data for

Your emails, live chat, private Facebook or social media conversations are deleted at the end of our contact session or within 12 months. This means you should keep copies of them in case of future queries as I will no longer have them.

Your personal data for marketing is held with your consent unless you ask for it to be deleted or changed as above.

Right to be forgotten

At any time, you can ask for a copy of the data held by emailing us at enquiries@purehealthclinic.co.uk. You can also cancel your shop account at any time, and/or ask for any data held by us to be deleted under your Right To Be Forgotten, amended or consent for it to be held revoked at any time by contacting us at the same address.

Data breaches

If there is ever a security breach where Ecwid, our email management system or Purehealth think your data may have been accessed by someone who shouldn’t have, we will let you know within 72 hours of becoming aware of it. We will do this by using the data we have saved to our email management system.

The Site has links to other websites which are outside our control and Purehealth Clinic is not responsible for Internet content or World Wide Web pages.

 

16 Advertising 

Any advertising on the site not generated by the Purehealth Clinic is the responsibility of advertisers and they must ensure it complies with all relevant laws and codes. We will not be responsible for inaccuracies in advertising material.
